ortiz shot in the back more than a week ago, rushed back to boston for emergency surgery. the bullet going through him and hitting someone else. you'll remember the surveillance showing him being shot point-blank. tonight, was this a case of mistaken identity? victor oquendo leading us off. >> reporter: tonight, new developments in the attempted murder of david ortiz. the dominican republic attorney general and the head of the national police revealing they believe ortiz was not the intended target of the attack. investigators say they believe his friend was the target, sitting at the same table, and dressed similarly. suspects arrested include cruz, who police say pulled the trigger. last week, the chief of police held up the gun he said was

used in the alleged ambush. authorities say this surveillance video shows the suspects riding a motorcycle to the scene. the hitman walks up and fires into ortiz's back, and he falls to the floor. some of the suspects also face possible criminal charges in unrelated cases in the u.s. cruz wanted for armed robberies in new jersey, and rivas wanted for conspiracy to commit attempted homicide in pennsylvania. this, as we learn the ten-time all-star is still in intensive care in a massachusetts hospital. his wife saying he's been upgraded to good condition. and thanking fans, writing, your support has lifted him tremendously. >> victor, prosecutors say this was a case of mistaken identity, and the hitmen were going off of a photo, that they did not know who they were told to assassinate until just minutes before the attack? >> reporter: that's right. prosecutors say the alleged assassin was basing his target

off of a photo taken minutes before with very poor lighting. he shot ortiz by mistake. that suspect's name, victor hugo gomez. they believe he's part of a drug cartel. he was last seen in the united states, and he's still on the run. >> victor, thank you. back here at home, and authorities are on the scene of a deadly highway inferno in wisconsin. a tractor-trailer tumbling off the highway. the truck exploding into a fireball. multiple vehicles catching fire. at least two people killed, and at least two people are in serious condition tonight. the highway shut down. traffic at one point backed up for miles. alex perez at the scene tonight. >> reporter: tonight, a deadly crash closing a major wisconsin highway. plumes of black smoke filling the sky. >> we got multiple vehicles on fire up on the interstate. >> reporter: a tractor-trailer, trying to avoid the pile-up, loses control. going off the road, bursting into flames. katelyn planka was driving on

the frontage road when there was suddenly a thick cloud of smoke in front of her. >> i was kind of scared that it was gonna blow up or something, and there was a lot of debris flying everywhere. >> reporter: multiple 911 calls streaming in around 11:00 a.m. after another tractor-trailer hit a construction barrier along i-41/i-94 in racine county. the truck crashing into the concrete median, pushing it into oncoming traffic. >> as a result, three passenger vehicles also collided with one another, within the barriers, within the wall itself. >> reporter: the drivers of the two semis were killed. two others taken to the hospital with critical injuries. david, this is one of the business busiest highways in the entire state. and it remains closed tonight. you see the crews still working to clear the scene. authorities hoping they can have this back open by late tonight. david? >> alex, thank you.

now to another scare today. a train derailment in northern nevada. union pacific says 22 cars jumped the tracks. several cars were carrying explosive munitions but those did not derail. the highway was shut down for some time. and tornado watches in several states. flooding concerns from missouri to the east coast. ohio now declaring a state of emergency. flooding forcing dozens from homes in clinton and other communities tonight. let's get right to rob marciano in denver, tracking this all for us. rob? >> reporter: hi, david. a culprit again, the front that won't move. it stretches into the high plains. now a tornado watch up in dallas, including shreveport as well. flood watches remain up along the i-70 corridor. the ohio river valley, into new jersey. a low will develop along the front, dragging it across the mississippi.

storms in memphis, birmingham, atlanta, and risk for damaging winds and more heavy rain. david? >> rob, thank you. former vice president joe biden facing backlash after what he said about congress needing to work together, the ability to work with others. but biden citing segregationist senators as examples. calling them mean, but that he worked with them. his opponents pouncing, just as the debate over reparations takes center stage on the hill. here's terry moran. >> reporter: in a packed hearing room, an emotional debate. should the federal government pay billions of dollars in reparations to african-americans who are descended from slaves as a way to make amends for the atrocity of american slavery? >> slavery is the original sin. slavery has never received an apology. >> reporter: this hearing, the first on the issue in a decade, actor danny glover and democratic senator and presidential candidate cory booker making the case for reparations.

hicks, testifying for hours behind closed doors. grilled by the house judiciary committee over examples of possible obstructions of justice listed in the mueller report. democrats furious about what she re's my bruce. >> repter: the president's former top aide and confidante hope hicks not commenting as she arrived on capitol hill today. ms. hicks, are you going to answer questions about your time at the white house? have you discussed today's testimony with the president at all? and inside the hearing room, she didn't have many answers either. a white house lawyer blocking her from answering any questions about her time in the administration, claiming she has what they describe as immunity. >> it could be as simple as, "where is your office located?" "objection." it is ridiculous. >> reporter: often seen but rarely heard. >> thank you, donald trump. >> reporter: hicks was by the president's side throughout the campaign and during his first year in office as his communications director. she was one of trump's most trusted advisers, and one of the most frequently named people in the mueller report. >> now hope hicks is a tremendously talented person.
